Terms and Conditions of Sale

Purchase Price and Availability

Buyer agrees to pay the total purchase price including shipping and handling, as specified on the front of the Seller’s invoice and any sales or other applicable taxes levied on or measured by such purchase. Seller reserves the right by giving notice to the Buyer at any time before delivery to increase the price of such Goods when they have not been delivered. Prices, promotions and availability are subject to change without any notice. Buyer shall be provided a formal quotation at Buyer’s request. If Buyer agrees and accepts the quotation, quotation is to be signed by Buyer or Buyer’s agent and order will be placed by either signed quote or by purchase order. Buyer understands the merchandise will be built according to the specifications on the quote and therefore the merchandise is non-refundable, non-exchangeable, ALL SALES ARE FINAL. Seller agrees to deliver merchandise as specifically quoted to the Buyer.

Refused or Re-Routed Shipment/Cancel Order

If Buyer refuses shipment and/or attempts to cancel or rescind this Agreement without any legal excuse, Seller may recover liquidated damages, consisting of 20% of the total price on Seller’s invoice plus all freight and handling charges. Notwithstanding the foregoing, Seller may refuse the return of Goods and seek its remedies under applicable law. Buyer shall pay all extra routing charges for any re-route shipment incurred by Buyer’s instruction or incorrect shipping information including, but not limited to, wrong address or wrong freight collect information.

Indemnification and Restriction

The Buyer agrees to indemnify, defend and hold Seller and any of Seller’s suppliers harmless from and against any and all liabilities, injuries, death, losses, claims, complaints, damages and expenses (including, but not limited to, reasonable attorney fees, court costs, costs of investigation and defense, and other related expenses) suffered, sustained, incurred, arising from the use and operation of the purchased Goods. The Goods sold by the Seller are not designed to be used and operated with any life support equipment, human implantation, medical devices, nuclear system, weapon, aviation, mass transit or any application where failure or malfunction could lead to possible loss of life, catastrophic property damage or any other critical situations. Therefore, Buyer takes its own risk if the Goods are resold for those purposes. Buyer agrees to take full responsibility for any forms of direct, indirect, special, incidental, consequential or punitive damage, arising our of the purchase and operation of the Goods.

Governing Law/Venue/Forum

This Agreement and the rights and obligations of the Buyer and Seller shall be governed by and construed in accordance with the laws of the State of California in the United States of America. Buyer further agrees to consent in jurisdiction, venue and forum in a State Court of California, County of Orange, State of California, United States of America. Buyer further agrees and does hereby irrevocably waive the defense of inconvenient forum and further irrevocably waives trial by jury. Any controversy, dispute, claim or complaint of whatever nature arising out of, in connection with, or in relation to the interpretation, performance or breach of this Agreement including any claim based on contract, tort or stature, shall be resolved through a binding, irrevocable and final Arbitration at JAMS/ENDISPUTE, County of Orange, State of California, United States of America. Both Buyer and Seller agree that such arbitration yield the final resolution.

Cancellation Policy

Buyer may cancel an order within two (2) business days of order receipt without penalty. Cancellations occurring after two (2) business days of order receipt may be subject to a cancellation fee of twenty percent (20%) of the total order amount.

Warranty Policy

RUFF PC CORPORATION WARRANTS THIS PRODUCT TO BE FREE FROM DEFECTS IN MATERIAL AND WORKMANSHIP UNDER NORMAL USE AND CONDITIONS FOR A LIMITED WARRANTY FROM THE DATE OF THE ORIGINAL PURCHASE.

THIS WARRANTY IS VOID IF THE PRODUCT IS:

- Damaged through negligence, misuse, abuse, or accident.
- Modified or repaired by anyone other than RUFF PC authorized service center personnel.
- Damaged due to connection to the equipment of other manufacturers, or improper power sources.
- The serial number sticker on the system is missing, defaced, or modified in any manner.

THIS WARRANTY DOES NOT COVER:

- Damages to the system due to parts of other manufacturers added to or connected to the product.
- Any costs in shipping the product to RUFF PC or a service center location.
- Damage or improper operation of the product caused by customer abuse, negligence, or failure to follow operating instructions provided with the product.
- Consumable parts and components of the system that fail to meet RUFF PC definition of defective, including, but not limited to LCD panels with less than twenty four (24) defective pixels.
- Any cosmetic damage to the system caused by accident or customer abuse.

THIS WARRANTY IS VALID ONLY IN THE UNITED STATES*. THIS WARRANTY APPLIES ONLY TO THE ORIGINAL PURCHASER**, AND IS NON-TRANSFERABLE. RUFF PC DISCLAIMS ALL WARRANTIES OF ANY KIND OTHER THAN THE ORIGINAL MANUFACTURERS LIMITED WARRANTY (OTHER THAN THE ONE STATED HEREIN). WHETHER EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

Fully Rugged Warranty Service

Standard Limited Warranty

RUFF PC DOT COM CORPORATION (HEREIN CALLED “RUFF PC”) WARRANTS THIS FULLY-RUGGED MODEL NOTEBOOK COMPUTER PRODUCT TO BE FREE FROM DEFECTS IN MATERIAL AND WORKMANSHIP UNDER NORMAL USE AND CONDITIONS FOR A PERIOD OF THREE YEARS FROM DATE OF ORIGINAL PURCHASE.
THIS WARRANTY IS VOID IF THE PRODUCT IS:

A. Damaged through negligence, misuse, abuse, or accident.
B. Modified or repaired by anyone other than RUFF PC authorized service center personnel.
C. Damaged due to connection to the equipment of other manufacturers or improper power sources.
D. The serial number sticker on the system is missing, defaced, modified or altered in any manner.

THIS WARRANTY DOES NOT COVER:

A. Damage to the system due to parts of other manufacturers added to or connected to the product.
B. Any costs incurred in shipping the product to RUFF PC or a service center location. All warranty repair service return shipments will be shipped via United Parcel Service (UPS) ground.
C. Damage or improper operation of the product caused by customer abuse, negligence, or failure to follow operating instructions provided with the product.
D. The compatibility or performance of any third party product used with or connected to the system.
E. Components of the system that fail to meet RUFF PC’S definition of defective, including, but not limited to, LCD panels with less than twenty four (24) defective pixels. ( Battery warranted for one year. Defective battery defined as not accepting an electrical charge.)
F. Any cosmetic damage to system caused by accident or customer abuse.
G. Third Party Hardware or software purchased through RUFF PC at the time of original sale and shipped with the Notebook will retain the warranty of the original manufacturer and not be increased nor decreased in warranty period length by this document.

THIS WARRANTY APPLIES ONLY TO THE ORIGINAL PURCHASER AND IS NONTRANSFERRABLE. RUFF PC EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND (OTHER THAN THE EXPRESS WARRANTY STATED HEREIN). THIS WARRANTY IS VOID IF THE PRODUCT IS:

Recon Warranty Service

Standard Limited Warranty

RUFF PC DOT COM CORPORATION (HEREIN CALLED “RUFF PC”) WARRANTS THIS PERSONAL DIGITAL ASSISTANT (PDA) PRODUCT TO BE FREE FROM DEFECTS IN MATERIAL AND WORKMANSHIP UNDER NORMAL USE AND CONDITIONS FOR A PERIOD OF ONE YEAR FROM DATE OF ORIGINAL PURCHASE.

THIS WARRANTY APPLIES ONLY TO THE ORIGINAL PURCHASER AND IS NONTRANSFERRABLE. RUFF PC EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND (OTHER THAN THE EXPRESS WARRANTY STATED HEREIN). WHETHER EXPRESSED OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

Although the Recon is built to rugged military specifications, as with any electronic product there may be occasions when it requires repair. RUFF PC offers two types of warranties, original and extended, to protect your investment.

The original warranty covers your Recon for a period of twelve (12) months from original date of purchase. There is no charge for this warranty. See the complete text of the Standard Warranty & Limitations below.

An extended warranty may be purchased, providing up to two additional years of coverage after the original warranty expires. The cost of extending the warranty for the Recon is only $225.00 per year.

If you want to take advantage of the opportunity to purchase extended warranty coverage, you must do so while the unit is still under its original warranty. You will need to provide an invoice showing your original purchase date. Extended warranty coverage mirrors the original warranty on the Recon. See the Extended Warranty page below for more details.

Standard Warranty and Limitations

RUFF PC Inc. warrants the product against defects in materials and workmanship for twelve (12) months from the original date of purchase. Recon accessories and peripherals are limited warranted against defects in materials and workmanship for ninety (90) days from the original date of purchase.

If notice is received of such defects during the limited warranty period, the proven defective product(s) will either be repaired or replaced, at the manufacturer's option. Replacement products may be either new or like new.

The manufacturer does not warrant that the operation of the products will be uninterrupted or error free. If the product is not, within a reasonable time, repaired or replaced to a condition as limited warranted, the customer will be entitled to a refund of the purchase price upon prompt return of the product.

Limited warranty does not apply to defects resulting from (a) improper or inadequate maintenance or calibration, (b) software, interfacing, parts, or supplies not supplied by manufacturer, (c) unauthorized modification, or misuse, (d) operation outside of the published environmental specifications for the product, or (e) physical damage due to external causes, including accident, abuse, misuse or problems with electrical power. Water damage caused by improper installation of the CF-cap is not covered by warranty. Removal of the backcase voids the limited warranty. There are important seals that will break and the Recon will no longer be waterproof.

To the extent allowed by local law, the remedies in this limited warranty statement are the customer's sole and exclusive remedies. Except as indicated above, in no event will the manufacturer or its suppliers be liable for loss of data or for direct, special, incidental, consequential (including lost profit or data), or other damage, whether based in contract, tort, or otherwise.

Extended Limited Warranty

What is covered by an extended warranty?
Mirroring the parameters of the original warranty, an extended warranty covers defects in materials or workmanship for the Recon for one or two years after the first year of coverage.

When should you buy the extended warranty?
An extended warranty must be purchased while your unit is under its original warranty. During the sale or anytime during the first year, you can add more warranty coverage.

What is the cost?
Suggested list price on the extended warranty for the Recon is $225.00 per year each additional year with a maximum of two years available.

How long does extended coverage last?
Extended warranty coverage is for one or two years beyond the initial year of coverage from RUFF PC. That means, you could buy a unit Jan 1, 2006 and have warranty coverage thru Dec 31, 2008.

Why buy an extended warranty?
An extended warranty can provide peace of mind and protection of investment. Although these products are rugged handhelds, they are, after all, electronic devices. Let's face it. Sometimes life just throws you a curve, and products need to be serviced or repaired. If you have an extended warranty, you're covered.

to get a Return Merchandise Authorization (RMA) number.

Note: You must be given an RMA number prior to shipping any equipment. Products received without an RMA number will not be accepted.

IMPORTANT! Always retain the original packaging for your system. You will need it to safely ship your system to RUFF PC for service or repair.

The information below pertains to service only in the continental United States. If you are located outside the United States, please contact RUFF PC for more detailed information.

If you experience a problem, RUFF PC Technical Support will try to help you through the problem. If the problem can not be resolved via the phone, instant messaging or email, a RMA number will be issued and the Service Process will begin. If you have purchased Upgraded Warranty service please mention it during the initial diagnosis phase so that proper attention is paid to your case. Your RMA number is very important. Write it down and be sure to keep it handy, even after your system has been sent to RUFF PC. Your RMA number is used to track your equipment. Should you need to call RUFF PC to check on your system, you will be asked for the RMA number.

Pack your unit in its original packaging, and put the RMA number on the out side of the box. You should also enclose a note that includes your return address, day time telephone number (fax number if applicable), a detailed description of the problem, Any user name and passwords needed to logon to your notebook with administrator privileges (used for testing purposes only) and a copy of your dated sales receipt, if available.

Please only ship the items requested by the technician, as RUFF PC will not be responsible for items not pertinent to the trouble shooting process. Upon receipt of your RMA, a detailed inventory of all items and any pre-existing damage will be kept with the RMA paperwork.

Your system will then be rushed to RUFF PC, repaired (at RUFF PC discretion) and then returned to you as quickly as possible. Standard return shipping is via United Parcel Service (UPS) Ground Service. Those who have purchased upgraded warranty service (I.E. Express 48) will receive faster shipping commensurate with their upgrade. All others can, at their discretion, pre-pay for quicker return shipping utilizing UPS, Federal Express (FedEx) or DHL.

Please Note: Out of Warranty RMA service repair is 3 months & includes parts and service for this repair only.

If during the course of the RMA process, no trouble is found, a standard diagnostic charge will be assessed at rate of $55.00/Hr not to exceed $150.00, which doesn’t include return shipping cost (Domestic Service). International service is at $55.00/Hr which doesn’t include return shipping cost which will be calculated on a case-by-case basis, based on location and availability.
